Berkeley’s Building Emissions Saving Ordinance (BESO), codified at Berkeley Municipal Code Chapter 19.81 and administered by the City of Berkeley’s Office of Energy & Sustainable Development, is a point-of-sale rule. When a covered building changes hands, BESO requires an energy assessment so the score is on the table before the deal closes. Effective January 1, 2026, the requirement for single-family homes and duplexes expanded: the seller has to obtain a Home Energy Score (a 1-to-10 score) from a qualified assessor before listing, post it in the MLS listing, and include the report in the disclosure and transfer documents. On top of the score, the new rules add a resilience-upgrade obligation (more on that below). What Berkeley BESO requires at point of sale (1–2 unit homes)

For single-family homes and duplexes, effective January 1, 2026, the seller’s BESO obligations break down like this.

Hire a qualified Home Energy Score assessor to evaluate the home (a separate score for each unit on a duplex) before the property goes on the market. The score runs 1 to 10.
Disclose it
Post the Home Energy Score in the MLS listing and include the full Home Energy Score Report in the disclosure and transfer documents to the buyer.
Meet the resilience-upgrade standard
Each unit must earn at least 6 credits under Berkeley's Resilience Standard by completing qualifying upgrades (e.g., a heat pump water heater or heat pump HVAC, each worth 6 credits) within about two years of sale.
Or defer the upgrades
The upgrade obligation can be deferred to the buyer with a Resilience Upgrade Deposit — a total of $5,000 ($2,500 each from the seller and buyer), refundable once the upgrades are verified.
Avoid the non-compliance fee

Larger buildings phase in later
