The best way to sell a house in pre-foreclosure depends on two things: how much equity you have and how much time is left before the trustee’s sale. If you have equity, selling before the sale, with an agent if time allows or to a cash buyer if it does not, usually protects it. If you owe more than the home is worth, a loan modification or short sale may fit better. Here is the California timeline and a fair comparison of each option.
How long does pre-foreclosure take in California?
Most California foreclosures are non-judicial and follow set minimum steps. The servicer must try to contact you at least 30 days before recording a Notice of Default (Civil Code 2923.5). At least three months must pass after the Notice of Default before a Notice of Sale (Civil Code 2924), and the Notice of Sale must come at least 20 days before the sale (Civil Code 2924f). So the sale is usually at least three months and three weeks after the Notice of Default, and often later if it is postponed.
Can you stop the foreclosure by catching up on payments?
Yes. California lets you reinstate the loan by paying the past-due amount plus allowed fees and costs, from the Notice of Default until five business days before the sale date, per Civil Code 2924c. Ask your servicer for a written reinstatement quote. If you can reinstate, you may not need to sell at all.
Option 1: Should you ask for a loan modification first?
If you want to keep the home and your income can support a new payment, ask your servicer for a loan modification or repayment plan. For an owner-occupied home, if you submit a complete first-lien modification application at least five business days before a scheduled sale, the servicer cannot move ahead with the sale while it is pending, per Civil Code 2923.6. A HUD-approved housing counselor can help you apply for free.
Option 2: Can you sell with an agent before the sale date?
Yes, if there is enough time. Listing usually brings the most money when the house shows well and you have months, not weeks. The risk is the clock: repairs, showings, a buyer’s loan approval and escrow all have to finish before the trustee’s sale. Ask the servicer in writing about postponing the sale once you are in escrow. Our cash offer vs. realtor comparison shows the costs side by side.
Option 3: When does selling as-is to a cash buyer make sense?
A cash sale fits when the sale date is close, the house needs work, or you cannot keep up with showings. You give up some price compared with a fully prepared listing, but you can close before the auction and keep the equity that is left after the loan is paid off. That is usually far more than you would get after a trustee’s sale. See what happens to your equity in a foreclosure.
California adds a protection here. If you live in the home and it is in foreclosure, a buyer who is buying it to resell or rent (an equity purchaser) must use a written contract, and you can cancel it until midnight of the fifth business day after you sign, or 8 a.m. on the day of the sale, whichever comes first, per Civil Code 1695.4. For transparency: we are a cash buyer. We have bought 300+ Bay Area homes since 2014, we close in 7 days or less, and we never wholesale. Our foreclosure guide explains how we work.
How much time do you have?
Send us your Notice of Default or Notice of Sale and the address. We will give you a written as-is offer and tell you plainly whether we can close before the sale date.
Option 4: Is a short sale better if you owe more than the house is worth?
A short sale means the lender agrees to accept less than the full loan balance. It needs lender approval, which takes time, so start early. For a one-to-four unit home owned by an individual, a lender that approves a short sale in writing cannot come after you for the remaining balance, per Code of Civil Procedure 580e. Ask a tax professional whether any forgiven debt is taxable for you.
Option 5: What about a deed in lieu of foreclosure?
With a deed in lieu, you sign the house over to the lender and it releases the loan. It avoids an auction but usually gives you no equity back, and the lender has to agree. The California Department of Real Estate’s consumer alert on foreclosure alternatives explains this and the other options.
Does bankruptcy stop a foreclosure sale?
Filing bankruptcy creates an automatic stay that usually pauses the sale, but it is a legal process with long-term effects. Talk to a bankruptcy attorney first. Our post on problems with using bankruptcy to stop foreclosure covers the tradeoffs.
What happens if the house goes to the trustee’s sale?
At the auction, the house goes to the highest bidder. For homes with one to four units, California gives tenant buyers and certain other eligible bidders, such as qualifying nonprofits, up to 45 days after the sale to step in, per Civil Code 2924m. Any money left after the loans and liens are paid goes to the former owner, but you have no say in the price. Selling before the sale keeps that control with you.
How do the options compare?
| Option | Best when | Main tradeoff |
|---|---|---|
| Reinstate the loan | You can pay the past-due amount | Must be done 5 business days before the sale |
| Loan modification | You want to stay and can afford a new payment | Paperwork and a servicer decision |
| List with an agent | You have equity and several months | Buyer loan and escrow must finish before the sale |
| Sell as-is for cash | The sale date is close or the house needs work | Price is usually below a fully prepared listing |
| Short sale | You owe more than the house is worth | Needs lender approval, which takes time |
| Deed in lieu | No equity and the lender agrees | Usually no money back to you |
How do you spot a foreclosure rescue scam?
Be careful with anyone who asks for money up front to save your home or guarantees they can stop the foreclosure. HUD warns that real foreclosure help should not require a fee, per HUD: Avoiding foreclosure. Never sign your deed over before you are paid at closing, get every promise in writing, and use a title company for escrow.
Where do we buy pre-foreclosure homes?
We buy across the Bay Area, including Oakland, Antioch, Vallejo, Richmond, Fairfield, Vacaville, Fremont and San Francisco. Each city page lists local transfer taxes and rules, with sources.
Pre-foreclosure FAQ (California)
Can I sell my house after a Notice of Default is recorded?
Yes. You own the home until the trustee’s sale, so you can sell it, pay off the loan and keep what is left. The earlier you start, the more options you have.
How late can I sell before the foreclosure auction?
Until the sale happens, as long as the sale closes and the loan is paid first. In practice you need enough time for escrow and a payoff. Send a buyer your Notice of Sale right away so they can tell you if the timing works.
Will selling in pre-foreclosure hurt my credit less than a foreclosure?
Missed payments are already reported, but a completed sale that pays off the loan avoids a foreclosure on your record. Ask a HUD-approved counselor how each option affects your credit.
Can I cancel a contract to sell my home in foreclosure?
If you live in the home and sell to an equity purchaser, yes. California gives you until midnight of the fifth business day after signing, or 8 a.m. on the sale day if that comes first, under Civil Code 1695.4.
How fast can Rapid Home Solutions close?
